For the sale of goods through the online store www.gr-rum.cz

1. Introductory Provisions

1.1. These Terms and Conditions (hereinafter referred to as the "Terms and Conditions") of GrRUM Distillery s.r.o. govern, in accordance with Section 1751(1) of the Czech Civil Code, the mutual rights and obligations arising in connection with or based on a purchase agreement concluded between the seller and the buyer through the seller's online store.

1.2. The seller does not sell alcoholic beverages to persons under 18 years of age. By submitting an order, the buyer confirms that they are at least 18 years old.

1.3. The online store is operated through the website www.gr-rum.cz and its web interface.

1.4. These Terms and Conditions do not apply to persons purchasing goods in connection with their business activities or professional practice.

1.5. Any provisions differing from these Terms and Conditions may be agreed upon individually in the purchase agreement. Such provisions shall take precedence over these Terms and Conditions.

1.6. The seller reserves the right to amend these Terms and Conditions. Any updated version becomes effective on the date of its publication on the website.

2. User Account

2.1. The buyer may register on the website and access their user account.

2.2. The buyer is required to provide accurate and up-to-date information when creating and managing their user account.

2.3. The buyer is responsible for keeping their login credentials confidential and must not disclose them to third parties.

2.4. The seller may cancel a user account, particularly if the buyer has not used it for more than one year or has breached their obligations under these Terms and Conditions.

2.5. The availability of the user account cannot be guaranteed at all times and may be interrupted due to maintenance, technical issues, or other operational reasons.

3. Conclusion of the Purchase Agreement

3.1. All product presentations displayed on the website are for informational purposes only and do not constitute a binding offer. The seller is not obliged to conclude a purchase agreement.

3.2. The website interface contains product prices including VAT, as well as information regarding delivery costs.

3.3. The buyer completes the order by clicking the "Complete Order" button. All information provided in the order is deemed correct by the seller.

3.4. The purchase agreement is concluded at the moment the order confirmation is delivered to the buyer's email address.

3.5. The seller reserves the right to request additional confirmation of the order.

4. Prices and Payment Terms

4.1. The purchase price may be paid using one of the following methods:

• Bank transfer to the seller's account

• Credit or debit card

• Through the GP WebPay payment gateway

4.2. The buyer shall also pay any costs associated with the delivery of the goods.

4.3. In the case of payment by bank transfer, the purchase price is due within 7 days.

4.4. The seller reserves the right to require payment of the purchase price before dispatching the goods.

4.5. Tax invoices are issued and delivered electronically.

5. Withdrawal from the Purchase Agreement

5.1. A consumer buyer has the right to withdraw from the purchase agreement within 14 days of receiving the goods.

5.2. Notice of withdrawal must be sent to the seller within the 14-day withdrawal period.

5.3. The buyer bears the costs associated with returning the goods.

5.4. The seller will refund all payments received after the returned goods have been received and inspected.

5.5. The buyer is responsible for any reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functionality.

5.6. The seller may withdraw from the purchase agreement at any time prior to the buyer taking delivery of the goods.

6. Shipping and Delivery of Goods

6.1. The buyer acknowledges that the shipment may contain alcoholic beverages.

6.2. The carrier or the seller is entitled to request a valid proof of identity for the purpose of verifying the buyer's age.

6.3. If the buyer fails to prove that they are at least 18 years of age, the shipment will not be handed over. In such a case, the order will be cancelled due to circumstances on the buyer's side, and the seller may claim reimbursement of any costs incurred.

6.4. The buyer is obliged to accept delivery of the shipment.

6.5. The buyer is required to inspect the shipment upon receipt and report any defects or damage to the carrier without undue delay.

7. Rights Arising from Defective Performance

7.1. Rights arising from defective performance shall be governed by the Czech Civil Code and applicable consumer protection legislation.

7.2. The seller is responsible for ensuring that the goods are free from defects at the time of delivery.

7.3. The warranty does not cover normal wear and tear resulting from ordinary use.

7.4. A consumer buyer may claim defects within 24 months from the date of receipt of the goods.

8. Additional Rights and Obligations of the Contracting Parties

8.1. Ownership of the goods passes to the buyer upon full payment of the purchase price.

8.2. The seller is not bound by any voluntary codes of conduct.

8.4. Consumer disputes may be resolved through the Czech Trade Inspection Authority (ČOI) at:

8.5. The seller is authorised to conduct business on the basis of a valid trade licence.

9. Personal Data Protection

9.1. Information regarding the processing of personal data is provided in a separate document entitled "Privacy Policy".

10. Marketing Communications and Cookies

10.1. The buyer agrees to receive commercial communications at the email address provided.

10.2. The buyer agrees to the use of cookies. Cookies may be disabled or rejected through the settings of the buyer's internet browser.

11. Delivery of Communications

11.1. Communications may be delivered to the buyer via the email address provided by the buyer.

12. Final Provisions

12.1. All legal relationships arising under these Terms and Conditions shall be governed by the laws of the Czech Republic.

12.2. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

12.3. Purchase agreements are archived electronically by the seller and are not publicly accessible.
